In this episode, Savannah brings up to Julie a specific Montana Legislature Senate Bill 458 that aimed to add more concise gender binary language into other existing state laws. As a result, the Two Spirit Society fought back as they felt the bill introduced and passed in October 2023 infringes on their inalienable rights to recognize two-spirit as a gender in their tribal culture. This raises questions about how government can enforce a gender binary limitation on laws when two spirit is a pre-existing cultural belief, and the scientifically recognized gender of Intersex is also at risk of erasure in the state.
